Wargaming Screws EU – Is North America next?

Here we go again, folks! Wargaming in their complete desperation has once again changed their Terms of Service for the EU area.

A lot of it is the same old bullshit but there are a few new sections you’re all going to want to pay VERY close attention to.

The first new change is a fucking lulu! Here it is:

2.1 If you are under the age of eighteen (18), please ask your parent or guardian to read and accept these Terms of Service on your behalf before you use the Services.

The age of consent is now 18. It’s always been 13 before and still is in North America.

Why this change? Well, to put it simply, lawsuits. The absolute toxicity and disgusting pedophilia anime environment of this game has reached the point that several lawsuits have been launched against Wargaming for providing adult content on a game marketed to minors.

Not surprisingly, this is something we discussed long ago. Also not surprisingly, we were right. Again.

But rather than clamp down on the assholes and perverts, Wargaming is simply raising the age of consent to that of a legal adult to remove themselves from any liability of providing a decent environment for everyone.

This, in effect, moves all of Wargaming’s titles from a rated E for Everyone to a rating of A for adults only.

Why are we NOT surprised?

Post script: We will be following up with the PEGI to insure that Wargaming upgrades its game rating on all of its titles accordingly.

Fun change number two, and this one is funny as fuck and quite possibly a financial bombshell:

6.5. [This section will come into force on 22 July 2019] If your issuing bank offers automatic account updater services (Visa Account Updater, Mastercard Automatic Billing Updater, or similar), these services may automatically update your payment card details in our acquirers’ systems when they change without any action on your part. If you do not want to have your card details automatically updated, please contact your issuing bank.

What that means, folks, is if you EVER paid for a year of premium on your Visa, Mastercard and that card has the option of automatic billing (and I’ve never seen a Visa or Mastercard that doesn’t have that option) then you MUST DISABLE IT ON THE CARD OR WARGAMING WILL USE IT WITHOUT YOUR PERMISSION.

If you’re not going to willingly give them your money, they will fucking TAKE IT. That is EXACTLY what that section says.

So if you quit playing the game a year ago and you suddenly open your credit card statement to see that you’ve renewed your premium time for a year without your knowledge, don’t say we didn’t warn you.

Section number three is probably going to wind up pissing off a LOT of World of Tanks and World of Warships fangirls regarding fan sites:

h) you must not make, or seek to make, any commercial use or profit out of the Fansite Content (including for example by selling subscriptions to your Fansite) without our prior written consent.

Whoops! So much for all those wonderful reviewers making a living on Wargaming’s shit. They’ll no doubt start hunting down anybody that’s monetizing their shit and suck them dry and/or shut them down.

Looks like you’ll finally have to get a real day job, fangirls!

The only exception, of course, are those who sell out and agree to only post great things about Wargaming products no matter how badly they suck. They’re allowed to make a buck provided they give Wargaming their cut and nothing but good press.

Criticize just once, you get fucking sued.

Which brings us to sunny point number four which frankly we expected long ago and we are well prepared for. It has to do almost exclusively with us, but also others who have tried to point out how fucking full of shit Wargaming really is with UGC (user generated content):

a) any part of the UGC which comprises or incorporates any of our intellectual property rights remains our property;

b) you must not upload any UGC that belongs to anyone else unless you have the respective right owner’s authorisation to do so;

d) you waive and agree not to assert any moral rights or similar rights you may have in UGC against us;

g) the UGC must comply with all relevant legislation and must not contain any material which may be considered offensive, defamatory, illegal or which could cause any reputational loss or embarrassment to us;

h) if you create any UGC, you are responsible and liable for it; we may, under circumstances, not bear any liability or responsibly for UGC, nor do we provide any support for UGC;

The skinny on this: They have no liabilities and every right. You and we have no rights and all the liabilities. You can only say good things about them and nothing that will “embarrass” them.

Excuse us for just one moment…

First off, good luck with that piece of shit agreement. Maybe in the EU you MIGHT get away with it, but it is in fact illegal here in the United States.

In the United States, any agreement that prohibits the rights of any party is automatically null and void.

So we’ll wait and see if they try to pull this bullshit off in North America. We seriously doubt it, but it does bring up a new question:

Why release this agreement ONLY in the EU?

Best we can figure is two fold:

  1. They knew that bullshit agreement would never fly here.
  2. They’re not going to bother because the NA server isn’t going to be around much longer.

We’ll wait and see. Maybe in the end it’s both.

    Wow.

    That is very, very odd – changing the agreement in EU and not NA. Normally that’s done across all platforms at the same time.

    Unless, like you suggest, they don’t really care about the NA server because it’s not going to be around a whole lot longer.

    That doesn’t effect PayPal. PayPal’s terms of service override Wargaming’s. By accepting PayPal to begin with, Wargaming takes on the same agreements that you do with PayPal.

    Same applies to the credit cards. What Wargaming says is pretty much a fucking waste of ink because they agree to the credit cards terms when they accept it. It’s just more bullshit to make people think they have no rights.

    Answer Because I believe it won’t hold in the US if taken to court. They could try and met someone with deep pockets… with connections to several major attorneys who would just love to make millions off of WG.

    But most of all This would open up their financial statements. “Games Workshop Vs Chapter house 2010”. In a nutshell Game workshop ( a bunch of UK assholes who tried to copy write Space Marines and the Chaos Icon that Moorcock used) Sued a small resin kit company. They claimed the usual bullshit of loss or revenue, copy writed infringement yada yada yada.

    It also forced GW to open up the financial books for all to see. Heh Heh Heh.

    Though in the end they spun it as a win in, they lost 60% of all of their catalog and had to rename everything. They also lost several million in the process and Chapterhouse paid little if any… Got a attorney and a good one on a Pro Bono Basis.

    WG does not want anyone knowing where they are getting their money from or how much money they are making… or all of the people that are tied to the company…

    That is why I believe for now on the reasons why they are not doing the NA… yet…

    I’m sure they have some concern already of American investigators digging around in the Cyprus banking system over Trump and friends, and like Icon Charlie said, imagine how many American lawyers would be grueling over a class action suit with someone like Wargaming and if you could bring Bill of Rights issues into it, crap instead of calling them ambulance chasers, we’ll be calling them tank chasers, lol
